By accessing or using bimproai.com (the "Site") or any BIM Pro AI services made available through the Site or associated applications (together with the Site, the "Services"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Services.

The Site is provided for informational purposes. Any BIM Pro AI software, tools, or outputs made available now or in the future are intended as research and documentation assistance to support licensed professionals — not as official code compliance determinations, permit guarantees, or substitutes for engineering or architectural judgment.

You acknowledge that BIM Pro AI does not provide legal, engineering, or architectural advice. You are solely responsible for compliance with applicable laws, codes, and professional obligations.

If you upload documents, model-derived data, or other content ("User Content") to the Services, you represent and warrant that you have all rights, licenses, and permissions necessary to upload and use that User Content with BIM Pro AI, including any proprietary standards, privately authored technical publications, or other third-party materials.

You agree not to upload User Content you are not licensed or authorized to use. BIM Pro AI does not verify users' license rights to any uploaded content and does not provide access to proprietary standards or publications. The Services are standard-agnostic: you determine what code document governs your project and supply that document yourself.

User Content is processed in-session to generate results for that session and is not written to persistent storage by BIM Pro AI or retained after the session ends. User Content is not used to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model operated by BIM Pro AI or its subprocessors.

You are responsible for any claims arising from your User Content or your breach of this representation, and you agree to indemnify and hold BIM Pro AI harmless from any such claims to the fullest extent permitted by law.

You may access and use the Site for lawful purposes. You may not scrape, reproduce, redistribute, or commercially exploit any content from the Site without express written permission. You may not use the Services for any unlawful purpose, to transmit malware, or in any way that could damage, disable, or impair the Services.

All content on the Site — including text, graphics, logos, design, and software — is owned by or licensed to BIM Pro AI. No license to reproduce, distribute, or create derivative works is granted without express written permission.

THE SERVICES AND ALL INFORMATION, OUTPUTS, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BIM Pro AI does not warrant that outputs will be accurate, complete, current, or suitable for any particular project or jurisdiction. BIM Pro AI outputs are designed to support professional review workflows; they are not a substitute for licensed professional judgment or official code compliance determination.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BIM PRO AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, BIM PRO AI'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNTS YOU ACTUALLY PAID TO BIM PRO AI FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT PAID ANY FEES TO BIM PRO AI IN THAT PERIOD, BIM PRO AI'S TOTAL LIABILITY SHALL NOT EXCEED ZERO UNITED STATES DOLLARS (US$0). IF APPLICABLE LAW DOES NOT PERMIT SUCH A LIMITATION, THIS PROVISION SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED.

BIM Pro AI respects intellectual property rights. If you believe material on the Services infringes your copyright, you may send a notice of claimed infringement that complies with the DMCA (17 U.S.C. § 512) to our designated agent at the contact information below. Include: identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your physical or electronic signature.

We reserve the right to update these Terms of Use at any time. We will post the revised terms on the Site and update the effective date. Continued use of the Services after changes are posted constitutes your acceptance of the revised terms.

These Terms of Use are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Subject to applicable law, you and BIM Pro AI agree that the state and federal courts located in Delaware shall have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction in those courts.
